SEC's Atkins Signals Rulemaking Path if CLARITY Act Stalls Before August Recess

• SEC Chair Paul Atkins confirmed the agency will issue its own crypto market structure rules if Congress fails to pass the CLARITY Act before the August recess.

• The CLARITY Act (H.R. 3633) passed the House 294-134 in July 2025 but remains stalled in the Senate with roughly two legislative weeks before recess.

• Atkins placed passage odds at approximately 55% and emphasized that only a statute can "future-proof" the regulatory framework against future administrations.

• The SEC's Project Crypto and a parallel CFTC initiative would advance token taxonomy, custody, trading, and distribution rules through exemptive and interpretive authority.
