Senator Elizabeth Warren has escalated her opposition to the latest draft of the Clarity Act, arguing the legislation would create pathways for President Donald Trump to personally profit while also empowering criminal enterprises and drug cartels. The Massachusetts Democrat outlined her concerns in a statement this week, characterizing the bill as a regulatory rollback disguised as consumer protection.

The Clarity Act, reintroduced in the House by Representatives French Hill and Bryan Steil, aims to establish a comprehensive framework for digital asset regulation by delineating jurisdiction between the Securities and Exchange Commission and the Commodity Futures Trading Commission. Proponents say the measure would provide long-sought regulatory certainty for the industry. Warren, a longtime critic of crypto markets, contends the current draft contains loopholes that would be exploited by bad actors.

According to Warren's office, the bill's definition of "decentralized" networks is sufficiently vague to allow centralized control to persist under a veneer of distributed governance. She argues this could enable political figures with business ties to digital asset ventures to influence policy outcomes directly. The senator specifically referenced Trump's recent involvement with World Liberty Financial, a decentralized finance project, as an example of the conflicts she believes the legislation would facilitate.

The senator's statement also raised concerns about anti-money laundering provisions. Warren asserted that the draft weakens know-your-customer requirements for certain tokenized assets and decentralized protocols, creating openings for sanctions evasion and illicit finance. She cited Treasury Department assessments from previous years identifying crypto mixers and non-compliant exchanges as tools used by North Korean hacking groups and narcotics traffickers.

Industry advocates have pushed back on Warren's characterization. The Blockchain Association, a trade group representing crypto firms, said the Clarity Act includes robust compliance mandates and that the decentralization test is designed to prevent exactly the sort of regulatory arbitrage Warren describes. A spokesperson for Representative Hill said the bill "strengthens, not weakens, enforcement tools" and accused Warren of mischaracterizing the text for political effect.
